Spendcal Terms of Service

1. Description of Service

Spendcal is a personal expense tracking and financial analytics tool that allows users to:

• Upload financial transaction data (such as CSV files)
• Categorize transactions using automated systems
• View summaries, dashboards, and reports
• Manage and analyze personal financial data

Spendcal does not connect directly to bank accounts. All financial data processed by Spendcal is provided directly by users.

Spendcal is not a bank, financial institution, broker, investment advisor, tax advisor, accountant, or fiduciary.

2. Eligibility

You must be at least 18 years old to use the Service.

By using Spendcal, you represent that:

• You have the legal capacity to enter into these Terms
• The data you upload belongs to you or you have authorization to use it
• You will use the Service only in compliance with applicable laws

3. User Accounts

To access certain features, you may be required to create an account.

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity occurring under your account
• Notifying us immediately of unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User-Provided Data

Spendcal processes financial transaction data uploaded directly by users.

You retain full ownership of all data you upload ("User Data").

By uploading data, you grant Spendcal a limited, non-exclusive license to store, process, analyze, and display your User Data solely for the purpose of providing the Service.

You represent that:

• You have the right to upload the data
• The data does not violate any laws or third-party rights

5. AI & Categorization Disclaimer

Spendcal may use automated systems, including machine learning models, to categorize transactions and generate insights.

You acknowledge that:

• Automated categorization may be inaccurate
• Insights are generated algorithmically
• You are responsible for verifying all outputs

Spendcal is not liable for financial decisions made based on categorized or analyzed data.

6. No Financial Advice

Spendcal provides informational tools only.

We do not provide:

• Financial advice
• Investment advice
• Tax advice
• Legal advice
• Accounting services

Any information provided through the Service is for informational purposes only.

7. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes
• Attempt to reverse engineer or extract source code
• Interfere with Service functionality
• Upload malicious or harmful files
• Use automated systems to abuse the Service

We may suspend or terminate access for violations.

8. Subscription & Payments (If Applicable)

If Spendcal offers paid plans:

• Subscriptions renew automatically unless canceled
• You may cancel at any time
• Fees are non-refundable unless required by law
• Pricing may change with advance notice

Payments may be processed by third-party providers such as Stripe.

9. Data Deletion & Termination

You may delete your account at any time.

Upon account deletion:

• Active access will be terminated
• Personal data will be deleted within a reasonable period
• Backup copies may remain for a limited retention period

We reserve the right to terminate accounts that violate these Terms.

10. Security

We implement reasonable security measures including:

• Encryption in transit (HTTPS)
• Access controls
• Secure hosting environments

However, no system is completely secure. You use the Service at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law:

• The Service is provided "AS IS"
• We disclaim all warranties
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for financial losses resulting from use of the Service

Your use of Spendcal is at your sole risk.

12. Indemnification

You agree to indemnify and hold harmless Spendcal and its affiliates from any claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your uploaded data

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time.

We will provide notice of significant changes. Continued use of the Service constitutes acceptance of updated Terms.
